{"id":66466,"date":"2020-10-16T08:48:57","date_gmt":"2020-10-16T08:48:57","guid":{"rendered":"https:\/\/www.copealcoy.es\/?p=66466"},"modified":"2020-10-16T16:13:24","modified_gmt":"2020-10-16T16:13:24","slug":"una-sentencia-obliga-al-ayuntamiento-de-cocentaina-a-dotar-de-proteccion-a-sus-trabajadores","status":"publish","type":"post","link":"https:\/\/www.copealcoy.es\/es\/una-sentencia-obliga-al-ayuntamiento-de-cocentaina-a-dotar-de-proteccion-a-sus-trabajadores\/","title":{"rendered":"Una sentencia obliga al Ayuntamiento de Cocentaina a dotar de protecci\u00f3n a sus trabajadores"},"content":{"rendered":"<p style=\"text-align: justify;\">Una <strong>sentencia del juzgado de lo social n\u00famero 1 de Alicante<\/strong> exige al Ayuntamiento de Cocentaina que <strong>dote a los trabajadores municipales<\/strong>, especialmente de aquellos que est\u00e1n cara al p\u00fablico, <strong>de los medios necesarios para prevenir el Coronavirus<\/strong>.\u00a0La citada sentencia <strong>llega despu\u00e9s de la demanda presentada por la Federaci\u00f3n de Sindicados de Empleados P\u00fablicos (FESEP)<\/strong> y en la que se exig\u00eda, desde el pasado mes de marzo tras la declaraci\u00f3n del Estado de Alarma, que <strong>la Polic\u00eda Local contara con equipos de protecci\u00f3n individual para cada agente<\/strong>. En el documento tambi\u00e9n se ped\u00eda <strong>un refuerzo de las medidas de higiene y prevenci\u00f3n<\/strong> as\u00ed como <strong>un contacto estrecho con las autoridades sanitarias<\/strong> del Departamento de Salud de Alcoy.<\/p>\n<p style=\"text-align: justify;\">Hay que recordar que el Consistorio contestano <strong>autoriz\u00f3 a realizar pruebas PCR a la Polic\u00eda Local y a los trabajadores de Servicios Sociales<\/strong> pero las mismas <strong>no se hicieron hasta principios de junio<\/strong> para estos \u00faltimos. A todo ello hay que sumar que a finales de julio <strong>se produjo el contagio de un agente por Covid-19<\/strong> que oblig\u00f3 a cerrar el ret\u00e9n policial durante unos d\u00edas y a <strong>derivar en la Guardia Civil la atenci\u00f3n de las cuestiones de seguridad de la poblaci\u00f3n<\/strong> &#8220;<em>el agente, que hab\u00eda estado trabajando los d\u00edas 27 y 28 de julio, comunic\u00f3 el d\u00eda 31 al concejal correspondiente que hab\u00eda contra\u00eddo el Coronavirus pero el edil le orden\u00f3 que no lo comunicara a los compa\u00f1eros.\u00a0Hasta el d\u00eda siguiente no se cerraron las dependencias municipales y se confin\u00f3 a la plantilla, con el consiguiente riesgo para el resto de agentes que trabajaron en esas dependencias, al menos, desde el 27 de julio y hasta su cierre<\/em>&#8220;, reza el texto de la sentencia.<\/p>\n<p style=\"text-align: justify;\">El documento insiste tambi\u00e9n en que <strong>la gesti\u00f3n que hizo de la situaci\u00f3n el Ayuntamiento supone un grave peligro para la salud p\u00fablica<\/strong> de los empleados municipales. Por \u00faltimo insiste en que <strong>se adopten todas las medidas para dotar a la plantilla de los medios de prevenci\u00f3n necesarios<\/strong> sin imponer <strong>sanci\u00f3n econ\u00f3mica alguna<\/strong> para el propio Consistorio &#8220;<em>est\u00e1 probada la puesta en peligro grave de la salud, integridad f\u00edsica del personal empleado por el demandado [el Ayuntamiento], en contacto directo con ciudadanos y la lesi\u00f3n del derecho a la protecci\u00f3n a la salud e integridad f\u00edsica de los mismos<\/em>&#8220;, se destaca.<\/p>\n<p style=\"text-align: justify;\">La sentencia <strong>puede ser recurrida<\/strong> y desde FESEP se ha asegurado que esta ser\u00eda <strong>la primera condena a un Ayuntamiento de la provincia de Alicante<\/strong> por poner en peligro la salud de los trabajadores municipales en plena pandemia sanitaria por el Covid-19.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Una sentencia del juzgado de lo social n\u00famero 1 de Alicante exige al Ayuntamiento de Cocentaina que dote a los&#8230;<\/p>\n","protected":false},"author":1,"featured_media":18561,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[98,75],"tags":[2120,9078,132,7281,846,516],"class_list":["post-66466","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-comarcas","category-noticias","tag-agentes","tag-ayuntamiento-de-cocentaina","tag-cocentaina","tag-coronavirus","tag-policia-local","tag-sentencia"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.7 -
