Tambi\u00e9n hemos recordado que <strong>los familiares de las v\u00edctimas mortales de Domus Vi han acordado no recurrir la sentencia\u00a0<\/strong>que conocimos el pasado enero.<\/p>\n<p style=\"text-align: justify;\">La decisi\u00f3n\u00a0<strong>se esperaba desde hace unas semanas<\/strong> y la hemos conocido en la pen\u00faltima de febrero. Los familiares de los fallecidos en la residencia Domus Vi de Alcoy durante la primera ola de la pandemia, <strong>a causa de un virulento brote de Coronavirus<\/strong>, han decidido no recurrir<span style=\"color: #0000ff;\">\u00a0<a style=\"color: #0000ff;\" href=\"https:\/\/www.copealcoy.es\/es\/el-juzgado-desestima-la-demanda-por-las-muertes-en-domusvi-alcoy\/\" target=\"_blank\" rel=\"noopener\"><strong>la sentencia<\/strong><\/a><\/span>\u00a0emitida por el Juzgado de Primera Instancia N\u00famero 3 de nuestra ciudad que conocimos el pasado mes de enero. En esta, como ya contamos en COPE ALCOY, el juez hab\u00eda considerado\u00a0<strong>que la empresa demandada no hab\u00eda incurrido en negligencia<\/strong>\u00a0respecto a la entrada y propagaci\u00f3n del virus ni en la atenci\u00f3n a los residentes. La decisi\u00f3n de no seguir adelante y recurrir viene motivada por \u00ab<em>el\u00a0esfuerzo econ\u00f3mico que supondr\u00eda continuar, tras casi cinco a\u00f1os de litigio, ya no es asumible<\/em>\u201d, afirman los familiares.<\/p>\n<p style=\"text-align: justify;\">Los demandantes insisten en que\u00a0<strong>la citada sentencia<\/strong>\u00a0\u00ab<em>es decepcionante<\/em>\u00bb y afirman que el hecho de que no se haya probado judicialmente la neglicencia\u00a0<em>\u00abno significa que no existiera<\/em>\u00ab. Tambi\u00e9n remarcan\u00a0<strong>las dificultades que tuvieron para acceder a la informaci\u00f3n<\/strong>, de cara a aportarla al proceso judicial, y afirman que se ha dado credibilidad a algunos informes cl\u00ednicos presentados por Quavitae pese a haber alertado sobre datos err\u00f3neos o contradictorios \u00ab<em>consideramos que una empresa como Quavitae, que gestiona la vida de personas vulnerables, deber\u00eda de haber adoptado medidas preventivas adicionales, m\u00e1s all\u00e1 del cumplimiento formal de una normativa obsoleta de 2005<\/em>\u00ab, indican. Tambi\u00e9n lamentan que los peritos de la misma parte demandada justifiquen el elevado n\u00famero de muertes en la vulnerabilidad de los residentes y\u00a0<strong>califican de aut\u00e9ntico \u00ab<em>caos<\/em>\u00ab<\/strong>\u00a0lo que se vivi\u00f3 en el geri\u00e1trico en aquella primavera del 2020 \u00abp<em>ersonas agolpadas, gerocultoras desbordadas e impotentes y una supervisi\u00f3n claramente insuficiente. Ese descontrol fue la antesala al silencio que vino despu\u00e9s<\/em>\u00ab, a\u00f1aden.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>La lucha sigue pese al cierre del proceso judicial<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Desde la Asociaci\u00f3n de Familiares Afectados<strong>\u00a0han anunciado cu\u00e1les son los objetivos que van a perseguir a partir de ahora<\/strong>. Pese al cierre judicial, han dejado claro que la lucha seguir\u00e1\u00a0<em>\u00abvamos a continuar trabajando para que nuestros mayores, y tambi\u00e9n nosotros que alg\u00fan d\u00eda podemos llegar a esa situaci\u00f3n, est\u00e9n en unas condiciones adecuadas en cualquier residencia.
