Tambi\u00e9n hemos comentado que ha sido desestimada <strong>la demanda<\/strong> por las muertes ocurridas en DomusVi Alcoy durante la primera ola de la pandemia.<\/p>\n<p style=\"text-align: justify;\">El\u00a0<strong>Juzgado de Primera Instancia e Instrucci\u00f3n 3 de Alcoy<\/strong>\u00a0ha desestimado\u00a0<strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.copealcoy.es\/es\/visto-para-sentencia-el-juicio-por-las-muertes-de-domusvi-alcoy\/\" target=\"_blank\" rel=\"noopener\">la demanda<\/a><\/span>\u00a0presentada por los familiares de 15 personas fallecidas y tres que sufrieron lesiones<\/strong>\u00a0en la residencia de ancianos DomusVi durante la pandemia de Covid-19. Los demandantes reclamaban\u00a0<strong>m\u00e1s de 2,2 millones de euros<\/strong>\u00a0en indemnizaciones, pero el tribunal ha concluido que no hubo actuaci\u00f3n negligente por parte de Quavitae Servicios Asistenciales SAU, la empresa que gestiona el centro.<\/p>\n<p style=\"text-align: justify;\">En una sentencia de\u00a0<strong>257 folios<\/strong>, notificada este jueves, el juez\u00a0<strong>analiza exhaustivamente las pruebas documentales y las declaraciones de testigos y peritos<\/strong>\u00a0que intervinieron en el juicio celebrado entre el 30 de septiembre y el 10 de octubre del a\u00f1o pasado. La resoluci\u00f3n se\u00f1ala que\u00a0<strong>no se ha demostrado que la empresa incurriera en negligencia<\/strong>\u00a0respecto a la entrada y propagaci\u00f3n del virus ni en la atenci\u00f3n a los residentes.<\/p>\n<p style=\"text-align: justify;\">El juez argumenta que una residencia no es un hospital y que\u00a0<strong>las condiciones excepcionales provocadas por la pandemia<\/strong>\u00a0superaron cualquier margen de normalidad. Destaca que tanto el sistema sanitario como el sociosanitario enfrentaron un \u00ab<em>desabastecimiento total<\/em>\u00bb de recursos, lo cual afect\u00f3 a nivel internacional y no puede ser imputado a la empresa demandada. Adem\u00e1s, subraya que las decisiones deben evaluarse con base en lo que se conoc\u00eda sobre el virus en marzo de 2020, cuando a\u00fan hab\u00eda incertidumbre sobre su transmisi\u00f3n.<\/p>\n<p style=\"text-align: justify;\">La sentencia tambi\u00e9n aclara que\u00a0<strong>DomusVi cumpl\u00eda con las ratios de personal requeridas y tom\u00f3 medidas para restringir visitas y sectorizar a los residentes desde los primeros d\u00edas del brote<\/strong>. El juez descarta cualquier desatenci\u00f3n hacia los residentes o incumplimiento de protocolos vigentes, se\u00f1alando que las recomendaciones sanitarias permit\u00edan aislar solo a aquellos con s\u00edntomas.<\/p>\n<p style=\"text-align: justify;\">Asimismo,\u00a0<strong>se absuelve a Mapfre<\/strong>, la aseguradora del centro, debido a una cl\u00e1usula en su p\u00f3liza que limitaba su cobertura hasta diciembre de 2020.
